1 Introduction

These terms and conditions outline the rules and regulations for the use of the Space Defence Security (SDS) Jobs Website (www.space-defence-security-jobs.com, hereinafter the “Website”). The Website is the property of AI Recruiting B.V.

The Website is a platform where organisations who have created an employer account (“Employers”) can post vacancies for jobseekers to find and apply to with or without signing up. We act as an intermediate, bringing Employers and potential employees together through the Website but are not responsible for the content of the job advertisements or for anyone being hired successfully for a vacancy.

These terms and conditions (“Terms”) apply to the use of the Website by anyone who is a jobseeker or other user of the Website without being a (registered) employer, so please read the Terms carefully before starting use. By using this Website, we assume you accept these terms and conditions in full. Minors or people below 18 years old are not allowed to use this Website.

You must only use the Website and any content available on it for lawful purposes and in good faith. You must not use it in any way that might damage our reputation or that of any of our clients or affiliates.

Other than the content you own, under these Terms, AI Recruiting B.V. and/or its licensors own all the intellectual property rights and materials contained in this Website.

You are granted limited license only for purposes of viewing the material contained on this Website.

2 Access to the Website and Account

You are responsible for ensuring your equipment (computer, tablet, mobile phone or other device) meets all the necessary technical specifications to enable you to access and use the Website, and is compatible with the Website. We support the current and most recent previous versions of all popular browsers. If your browser is not supported, you may still be able to access the Website but may encounter some display problems.

We cannot guarantee uninterrupted or error-free access to the Website or any of its features. At times, the Website, some of its features or parts may become unavailable or be modified or removed by us without any notice to you.

Any user ID and password you may have for this Website are confidential and you must maintain their confidentiality. We may suspend your account or require you to change your password if we have reason to believe that there has been a breach of security or misuse of your account. You should also inform us if you find out about such breach of security or misuse or suspect either to have occurred. We may suspend or terminate your account if you have breached any of these Terms and Conditions.

You may delete your account or stop using the Website at any time. You understand and acknowledge that by doing so, all your account information, including your preferences, CV, previous applications and saved jobs, may be deleted from our databases, and you will lose access to it. We may retain information you have submitted to us if required in accordance with applicable law and our Privacy Policy.

3 Your Responsibilities

You are responsible for the information provided to us and potential employers through the Website. The information that you provide in your application or when registering an account must relate to yourself and be true and accurate to the best of your knowledge. You may not register an account or apply for a job on someone else’s behalf. It is your responsibility to update your CV and account information regularly.

4 Reward Scheme

The reward scheme is only applicable to jobs posted by organisations that have a Premium Employer account.

If you have applied for a job posted by a Premium Employer through the Website and sign an employment contract (or other contract to provide work) with or through that Premium Employer within 12 months of your application, you will be entitled to claim a reward from us. The reward will amount to 2.5% of your first year remuneration (salary).

We may get this information from the Employer but we also encourage you to send us the following information after you have signed a contract:

  • Title of the job position on the Website
  • Reference of the job position on the Website
  • Your name
  • Gross remuneration (salary) for the first year of work
  • Date of contract signature with Employer
  • Job start date

You should submit this information by email to sds-jobs@ai-recruiting.com.

To be able to pay you your reward, we will request some additional payment information from you. You agree to provide this payment information and acknowledge that we will not pay you if you do not. It is your responsibility to declare this reward to the relevant tax authorities if necessary according to the applicable legislation in your country of tax residence.

The reward will be paid to you within 10 days of the day we receive the corresponding fee from the Employer/client, if we have received the payment information from you.

You agree to act in good faith towards us and to abstain from trying to circumvent or abuse the reward system in any way. If we, upon our discretion, consider that you have abused or tried to abuse the reward scheme, no reward will be due to you and any rewards already paid to you will be claimed back.

5 Intellectual Property Rights

Other than the content owned by you, under these Terms, AI Recruiting B.V. and/or its licensors own all the intellectual property rights and materials contained in the Website (“Website Material”). This includes (but is not limited to) the SDS Jobs logo and the conversational technology on the Website (the chatbot currently called “Julia”). The Website may also include some material that has not been licenced to us directly but that was publicly available and has been reproduced by us.

You are granted limited rights only for purposes of viewing the Website Material. You may download and print a single copy of the content available on the Website solely for your personal, non-commercial use. You need to inform us and agree with us beforehand if you want to use any Website Material commercially.

6 Linking to and from the Website

You may link to the Website, provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it, but you must not establish a link in such a way as to suggest any form of association, approval or endorsement on our part where none exists. You must not establish a link from any Website that is not owned by you. The Website must not be framed on any other Website without prior permission. We reserve the right to withdraw linking permission without notice.

Where our Website contains links to other websites and resources provided by third parties, these links are provided for your information only. They do not signify that we endorse the website(s). We have no control over the contents of those websites or resources and accept no responsibility for them or for any loss or damage that may arise from your use of or reliance on them.

7 Limits to Use

You are specifically restricted from using the Website:

  • in any way that impacts user access to the Website;
  • to spread anything that contains software viruses, worms, or any other harmful code; and
  • contrary to applicable laws and regulations, or in any way that may cause harm to the Website, or to any person or business entity.
8 No Representations or Warranties

This Website is provided “as is”, with all faults, and AI Recruiting B.V. expresses no representations or warranties of any kind related to this Website or the materials contained on this Website. We cannot and do not guarantee that any content of the Website will be free from viruses and/or other code that may have contaminating or destructive elements.

Also, nothing contained on this Website shall be interpreted as advising you. We cannot guarantee accuracy or success of matching to jobs nor that you will be selected for interviews or hired for any position by the organisations advertising on the Website. We are not responsible for the information included in the job postings, nor their accuracy and completeness. However, if you have reason to believe that a job posted on the Website is, in fact, a scam, please email us at sds-jobs@ai-recruiting.com.

9 Liability

In no event shall AI Recruiting B.V., nor any of its officers, directors and employees, be held liable for anything arising out of or in any way connected with your use of this Website regardless of whether such liability is under contract. AI Recruiting B.V., including its officers, directors and employees shall not be held liable for any indirect, consequential or special liability arising out of or in any way related to your use of this Website.

In no circumstances do we limit or exclude our liability for death or personal injury arising from our negligence, nor our liability for fraudulent misrepresentation or misrepresentation as to a fundamental matter, nor any other liability which cannot be excluded or limited under applicable law.

We shall not be a party to any employment contract or other agreement to perform work between you and any organisation advertising on the Website and shall not be responsible in any way for the behaviour of such organisations.

10 Indemnification

You agree to indemnify AI Recruiting B.V. to the fullest extent from and against any and/or all liabilities, costs, demands, causes of action, damages and expenses arising in any way related to your breach of any of the provisions of these Terms.

11.2     Cookies

Most of the modern day interactive websites use cookies to enable the retrieval of user details for each visit. Cookies are used in some areas of the Website to enable the functionality of this area and ease of use in accordance with our Cookie Policy.

11.3     Severability

If any provision of these Terms is found to be invalid under any applicable law, such provisions shall be deleted without affecting the remaining provisions herein.

11.4     Variation of Terms

AI Recruiting B.V. is permitted to revise these Terms at any time as it sees fit, and by using this Website you are expected to review these Terms on a regular basis.

11.5     Assignment

AI Recruiting B.V. is allowed to assign, transfer, and subcontract its rights and/or obligations under these Terms without any notification. However, you are not allowed to assign, transfer, or subcontract any of your rights and/or obligations under these Terms.

11.6     Entire Agreement

These Terms constitute the entire agreement between AI Recruiting B.V. and you in relation to your use of this Website and supersede all prior agreements and understandings.

11.7     Governing Law & Jurisdiction

These Terms will be governed by and interpreted in accordance with the laws of the Netherlands, and you submit to the non-exclusive jurisdiction of the courts of The Hague for the resolution of any disputes.

These Terms constitute the entire agreement between AI Recruiting B.V. and you in relation to your use of this Website and supersede all prior agreements and understandings.
